1. The petitioner No. 1 (Neeraj Maheshwari) is present today and his personal appearance is dispensed with.

2. It is submitted by Mr. Sengupta, learned Advocate for the petitioners that the petitioner No. 2 (Sriram Maheswari) is aged about 77 years and he is at present admitted in nursing home.

3. Mr. Sengupta thus requests this Court to dispense with personal appearance of the petitioner No. 2. The personal appearance of the petitioner No. 2 is dispensed with on medical ground.

4. At this stage, Mr. Sengupta, learned Advocate for the petitioners submits before this Court that he has instruction from his clients not to proceed with the instant matter any further.

5. In view of such, CRR 3938 of 2012 is dismissed for nonprosecution.

6. Interim order(s), if there be any, stands hereby vacated.

7. Department is hereby directed to forward a copy of this order to the learned Trial Court forthwith along with the LCR, if received, in the meantime.

8. Liberty is given to learned Advocate for the petitioners to file the vakalatnama in the department preferably in course of this day. Upon such filing department is directed to tag such vakalatnama

along with the instant case record.
