Learned advocate appearing for the petitioner submits that petitioner happens to be the husband of the deceased and he is similarly situated as other accused persons who have been granted bail in CRM (M) 2531 of 2025. It has been submitted that because of matrimonial discord and dispute the wife consumed poison and committed suicide.

Learned advocate for the State opposes the prayer for bail and submits that there are statement of the relations which reflects that poison was administered which contributed to the death. Having regard to the period of detention of the present petitioner and the fact that petitioner is similarly situated as other accused persons, so far as the issue relating to the death of the wife of the present petitioner is concerned, I am of the opinion that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Masrequl @ Masrekul @ Marsrekul Alam shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, Chanchal, Malda.

Learned trial Court will accept the bond of the present petitioner after the stage of consideration of charges are over on 6th February, 2026 and impose such other conditions as it deems fit and proper.

As such, the application for bail being CRM (M) No. 4 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
