We have considered the materials on record. Report shows seized coal was delivered by Area Sales Manager, ECL, Satgram to M/s. Rajshyama Enterprise and the plea that the coal was received by Joy Maa Tara Enterprise through Radha Impex is not borne from the records of ECL, Satgram. It is also appears challan which was used to carry the said coal on the petitioner's truck was issued earlier and was not valid at the time when the seizure was made. Taking these materials on record into consideration, it appears that the coal carried by the petitioner was never lawfully supplied to Joy Maa Tara Enterprise and is accordingly stolen property.

In such view of the matter, we are not inclined to grant anticipatory bail to the petitioner.
