Petitioner has challenged the proceedings relating to Survey Park Police Station Case No.87 of 2021 dated 19.04.2021 which is a proceeding under Section s 420/120B/406 of the Indian Penal Code and is pending before the learned ACJM, Alipore. The petitioner is yet to receive the documents under Section 207 of the Code of Criminal Procedure.

Accordingly, I direct the petitioner to take out an application in the nature of Section 239 of the Code of Criminal Procedure before the learned ACJM, Alipore or the learned trial court after receipt of the documents under Section 207 of the Code of Criminal Procedure. Learned trial court would consider the same in accordance with law independently without being influenced by any observations made by this Court.

With the aforesaid observations, CRR 4924 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.
