Again, the anxiety of the petitioner is that in spite of informing the police authorities regarding the false evidence, no action has been taken by the police authorities, as such, he is suffering irreparable loss and injury.

Learned advocate for the State submits that considering the nature of the

accusations which have been forwarded by way of an information on or about 01.10.2024, the police authorities are not empowered to directly register a case.

In case, the petitioner has any grievance, he would either file an application under Section 175(3) of the BNSS and/or, in the alternative, under Section 379 of the BNSS before the learned jurisdictional civil court.

Having considered the observations made above, the petitioner would be at liberty to take appropriate step before the appropriate forum.

With the aforesaid observations, WPA 30020 of 2024 is disposed of.
