Petitioner is aggrieved by the fact that a representation was made to the Officer-in-charge, Beleghata Police Station as also to the superior officer being the Deputy Commissioner of Police, Eastern Suburban Division, Kolkata. The grievance of the petitioner is that the petitioner is not allowed to enter the paternal home and to that effect a representation was advanced to the police authority.

State has submitted a report. Report reflects that the dispute is between the brother and sister. Brother claims that the father during his lifetime executed a will in his favour. In view of the report submitted by the Officer-in-charge, Beleghata Police Station, I am of the opinion that if the petitioner has materials in possession, petitioner would approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess and ascertain relating to the genuineness of the allegations and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations, WPA 30264 of 2024 is disposed of.

Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
