Banerjee Mr. Agniswar Chowdhury ...for respondent nos.7 & 8 The petitioner alleges unauthorized construction at the behest of respondent nos.7 and 8 at premises no.169/A, at Hyderpur East, Ward No.16 under English Bazar Municipality.

Learned advocate appearing for the petitioner has drawn attention of this Court to an order dated July, 28, 2022, passed by the Additional District Magistrate to argue that the construction in question has not been raised in terms of the sanctioned plan of the Municipality.

It appears that the petitioner has made a representation before the English Bazar Municipality dated August 2, 2022, for demolition of the unauthorized construction. It is the grievance of the petitioner that said representation has not yet been considered.

Ms. Sonal Sinha, learned advocate representing the Municipality submits that the representation dated August 2, 2022, would be considered by the Municipality in accordance with law.

In the aforesaid facts, this writ petition is disposed of with a direction upon English Bazar Municipality to dispose of the representation (appearing at Page 34) in accordance with law. The Municipality shall hear all necessary parties and pass a reasoned order within a period of one month from the date of communication of this order.

Accordingly, WPA 28763 of 2023 is disposed of.
