1. It has been submitted that an appeal was carried from the order dated 9th July, 2025 passed by this Bench.

2. The appeal being MAT 1099 of 2025 in the matter of Abhigyan Roy Vs. Indrani Roy & Ors. has been dismissed by the Hon'ble Division Bench today.

3. The application filed by the petitioner before the Sub Divisional Officer seeking maintenance under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is pending consideration. The said matter could not be proceeded as the son of the petitioner did not enter appearance. As the son is being represented by the learned counsel before this Court, accordingly, the said respondent is directed to respond to further notices that may be issued by the Sub Divisional Officer for disposal of the application for maintenance that is pending consideration.

4. As it has been submitted that the son of the petitioner is seafarer and is sailing, accordingly, the Sub Divisional Officer shall permit virtual appearance of the private respondent. It has been reported that the contract of the private respondent is due to end in November, 2025.

5. Notice of the proceeding shall be served on the son of the petitioner over mobile no. 9147073472 and email id. abhigyan.indian@gmail.com.

6. The Sub Divisional Officer is directed to consider and dispose of the application for maintenance filed by the petitioner at the earliest but positively by December, 2025.

7. The writ petition stands disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
