And In the matter of: Debashis Haldar @ Bappa .... Petitioner Md. Bani Israil ...for the petitioner Mr. Ranabir Roy Chowdhury Mr. Subham Bhakat ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. He has not been named in the FIR, but has been mentioned in the charge sheet. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. It is alleged that the petitioner and others forcibly gheroed a police station and then tried to have one of the arrested accused, charged with gambling, released from the police station. Some police officers were injured in the process.

Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected.
