The application for condonation of delay under Section 5 of the Limitation Act has been taken up for consideration though it is not listed today.
The instant application for Special Leave to Appeal is barred by limitation by 30 days. Though an application is filed way back on 28th July, 2017, the said application was not moved. Previously the instant matter appeared before a Co-ordinate Bench on 4th December, 2017. On that date the petitioner remained unrepresented. Today also the petitioner is absent. Nobody appears on behalf of the petitioner.
In view of such circumstances, the instant application under Section 5 of the Limitation Act is rejected for non-prosecution.
Consequently, the application for Special Leave to Appeal is also rejected being barred by limitation as well as for non-prosecution.
