This Court does not find any reason to keep the contempt application pending. At the request of the petitioner, the Belegachhi Gram Panchayat has approached the Block Land & Land Reforms Officer for appointment of a surveyor.

Under such circumstances, the contempt application is disposed of. The contempt proceedings are dropped. The petitioner is at liberty to file a fresh writ petition with regard to the other factors which emerged during the three measurements which had taken place pursuant to the order of the Court. According to the petitioner, those measurements were not done in a proper manner and the Block Land & Land Reforms Officer should be requested for the aforementioned exercise. The writ petition was filed alleging unauthorized construction. This court passed

certain directions. Measurements were taken by the gram panchayat on three occasions. The petitioner was not satisfied.

Thus, the petitioner requested survey/measurement by the Block Land and Land Reforms Officer. The matter now gone beyond the scope of the writ petition and the order of this Court. Accordingly, the petitioner may file a fresh writ petition, for the further relief he is praying before this court.
