The petitioner submits that the de facto complainant has filed an application for further investigation before the learned Judicial Magistrate, 2nd Court, Barasat in connection with Barasat Police Station Case No.691/22, however, he would not like to press the said application for further investigation and intends to proceed with the trial as expeditiously as possible. The case was initiated on or about 27th September, 2022. The stage of consideration of charges is not complete till date.
In view of the aforesaid, the learned Judicial Magistrate, 2nd Court, Barasat is directed to overcome the stage of consideration of charges on the next date so fixed or within a fortnight thereafter. After consideration of the charges, if the Judicial Magistrate is of the opinion that the trial of the case is required to be proceeded, he would fix a date in every two months so that the trial of the case can
be taken to its logical conclusion within a reasonable period of time.
No unnecessary adjournment should be granted to the parties.
Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.
With the aforesaid observations, CRR 4933 of 2023 is disposed of.
Pending application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
