Kausik (Rejected) CRM (NDPS) 3 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Palashipara Police Station Case No. 613 of 2024 dated 10.12.2024 under Sections 21(c) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that although the accusations are for alleged recovery of 460 Gms. of Heroin but the two independent witnesses being PW 3 and PW 4 have become hostile. Petitioner may as such be released on bail.

Learned advocate for the State submits that out of 9 witnesses proposed to be examined, 5 witnesses have already been examined.

In view of the present stage of the case, if the 4 witnesses proposed to be examined by the prosecution are not

completed within 3 months from the next date so fixed, learned Special Court would release the petitioner on bail. Accordingly, CRM (NDPS) 3 of 2026 is disposed of with the aforesaid directions.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
