Learned advocate appearing for the petitioner submits that petitioner was arrested on 12.11.2024 and since then he is in custody. The allegations in the FIR reflect that petitioner along with another went in a motorcycle without any number plate fired at the victim/deceased and thereafter fled away. There are three accused persons one is absconding. Be that as it may, presently the trial is being faced by Jakir Gazi and the present petitioner.

Learned advocate for the petitioner submits that there are more than 50 witnesses on whom prosecution has relied upon. Having regard to the gravity of the offence, I am not inclined to release the petitioner on bail.

However, State is directed to complete the evidence of the vulnerable witnesses within a period of one year from date. Petitioner would be at liberty to approach this Court after the evidence of the vulnerable witnesses are over. Accordingly, CRM (M) 13 of 2026 is dismissed at this stage.
