The petitioner seeks mutation of records in respect of a property at premises no.60/135, Haripada Dutta Lane, Ward No.94, Kolkata-700033 on the strength of two gift deeds dated June 22, 2017 and June 14, 2018.
It appears that Kolkata Municipal Corporation by a letter dated September 27, 2022, sought certain clarification regarding the relevant premises. In turn, the Kolkata Metropolitan Development Authority (KMDA) by a letter dated February 21, 2024, asked for some information from the first Land Acquisition Collector, Kolkata with regard to the relevant plot.
Learned advocate representing Kolkata Metropolitan Development Authority submits that no response has been received from the said authority till date.
In view of the aforesaid facts, I dispose of this writ petition with the following orders :
1) The first Land Acquisition Collector, Kolkata shall provide the necessary information to Kolkata Metropolitan Development Authority in response to the letter dated February 21, 2024, within a period of one month from date.
2) Upon receiving the information, the Kolkata Metropolitan Development Authority shall respond to the letter dated September 27, 2022, issued by the Kolkata Municipal Corporation within a period of one month thereafter.
3) Based upon the communication received from Kolkata Metropolitan Development Authority, the Kolkata Municipal Corporation shall decide the issue of mutation within a period of one month thereafter. Needless to mention that in arriving at its decision the Corporation shall hear all the necessary parties. With the aforesaid direction, WPA 28907 of 2023 is disposed of.
