Petitioner prays for bail on the ground of false implication. 2.

Learned Advocate appearing for the petitioner submits that, the petitioner was arrested in connection with one police case. Petitioner was shown arrested in the present police case. He submits that, no recovery was made from the possession of the petitioner.

Learned Advocate appearing for the State submits that, on the basis of a leading statement made by the petitioner while in custody, recovery of commercial quantity of contraband was made from the abandoned house belonging to the grandmother of the petitioner.

Considering the fact that the commercial quantity of contraband was recovered on the leading statement made by the petitioner albeit in custody and that too from the abandoned house of his grandmother, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected. 6.

CRM (NDPS) 1988 of 2024 is dismissed.
