Kausik (Rejected) CRM (NDPS) 4 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baishnabnagar Police Station Case No. 1190 of 2024 dated 29.10.2024 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner has been falsely implicated in connection with the instant case. It has been submitted that petitioner has been shown arrested in this case along with other cases. In one of the case, the petitioner was granted bail by this Court. Learned advocate submits that charge sheet and the supplementary charge sheet has already been submitted in connection with the instant case.

Learned advocate for the State opposes the prayer for bail and submits that the subject matter of the case relates to recovery of 516 Gms. of Brown Sugar.

I have taken into account the earlier order of rejection of the present petitioner in CRM (NDPS) 1024 of 2025 which was mainly on the antecedents of the present petitioner in connection with NDPS cases being Kaliachak Police Station Case No. 723 of 2024 and Kaliachak Police Station Case No. 758 of 2025.

Learned advocate appearing for the petitioner has submitted that in the initial charge sheet petitioner's name did not appear but subsequently he has been named in the supplementary charge sheet.

Be that as it may, at this stage, I find there is no change of circumstances.

Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are over. Accordingly, CRM (NDPS) 4 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
