Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case. Petitioner was arrested on 19.05.2025 and since then he has been in custody and charges has already been framed. As such according to the petitioner further detention is unwarranted. Learned advocate for the State, on the other hand submits that pursuant to the statement of the present petitioner there were recovery of 50 bottles of Phensedyl. The subject matter of the case involved number of Narcotic and Psychotropic Substances being recovered from different accused persons.

Having considered that the case is in progress and there is recovery, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted in the present case. The prayer for bail at this stage of the petitioner in CRM (NDPS) 5 of 2026 is dismissed accordingly.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
