The petitioner has filed an application for recalling /modification of the order dated 4th January, 2024.

It appears that an issue has been raised with regard to the plot number where the petitioner alleges unauthorized construction. According to the petitioner the proper plot number is 313/3, Nabapally, Salt Lake, Kolkata -700 105.

Learned advocate representing the Bidhannagar Municipal Corporation submits that the alleged unauthorized construction has been made on plot number RA 313 at Sukanta Nagar.

According to the Corporation the subject construction has been duly identified. The petitioner insists that the unauthorized construction is yet to be identified by the Corporation.

For the purpose of ascertaining the proper plot number and the unauthorized construction, let further spot inspection be conducted upon prior notice to the petitioner by the engineers of the Corporation. The petitioner will be

liable to identify the structure where the unauthorized construction has been made.

It will be open for the engineers of the Bidhannagar Municipal Corporation to seek assistance of the Block Land and Land Reforms Officer, Rajarhat with request to remain present at the time of spot inspection for the purpose of ascertaining the plot number and the structure in question.

The writ petition stands adjourned till 17th of June, 2024.
