2) Matter is heard in presence of learned advocates representing the petitioner, State respondents and West Bengal Central School Service Commission (for short, <Commission=). 3) Petitioner participated in 2nd State Level Selection Test, 2025 (for short, <2nd SLST,
2025=) for being appointed as Assistant Teacher in Economics (PG) for Classes XI-XII. Petitioner was declared successful in written test and in the list prepared by the Commission for participation in Personality Test name of the petitioner featured. Petitioner was intimated to appear before the Interview Board on 19th December, 2025 at 10:00 am by the concerned authority Commission.
However, petitioner could not appear before the Interview Board on medical issue. Petitioner prays for direction upon the concerned authority of the Commission to permit her to participate in ongoing Personality Test.
4) Mr.
Bandyopadhyay, learned Senior Advocate representing the Commission has opposed this writ petition and it is submitted that if petitioner is permitted to participate in ongoing Personality Test flood-gate will open and similarly circumstanced other candidates will get right to approach the authority for consideration of candidature belatedly. It is contended on behalf of the Commission that since process relating to Personality Test is almost complete and final list has been prepared based on Personality Test Commission would find it difficult to
accommodate the petitioner by permitting her to participate in ongoing Personality Test at this belated stage.
5) In addition thereto, attention of this Court has been drawn to page 50 of the writ petition which is letter dated 22nd December, 2025 of the petitioner addressed to the Chairman of the Commission seeking permission to participate in the Personality Test. In reference to this letter dated 22nd December, 2025, it is submitted that medical issue was not the only issue for which petitioner could not appear before the Interview Board on 19th December, 2025 but there was other issue relating to family of the petitioner. It is submitted that medical documents which are annexed to this writ petition were not disclosed at the time of sending letter dated 22nd December, 2025 to Commission seeking permission to participate in Personality Test.
6) Considering the submissions made on behalf of the parties and taking note of the facts involved in this writ petition, Court finds that petitioner participated in 2nd SLST, 2025 for being appointed as Assistant Teacher in Economics (PG) for Classes XI-XII. Petitioner qualified in written test and after first round of
selection process marks was allotted to the petitioner which took her within the zone of consideration.
Before commencement Personality Test petitioner was intimated to appear before the Interview Board on 19th December, 2025 at 10:00 by intimation letter which is at page 44 of the writ petition but petitioner could not appear before the Interview Board on medical ground and in support of same medical documents are annexed to this writ petition which are at pages 46-49 of the writ petition. On perusal of a prescription issued by a medical practitioner dated 18th December, 2025, it appears that petitioner was advised to take bed rest. It is also necessary to record herein that Personality Test is still continuing but it is submitted on behalf of the Commission that in respect of Economics (PG) Personality Test is complete.
7) However, taking note of the fact that petitioner was not medically fit on scheduled date of Personality Test i.e. 19th December, 2025 and as the Personality Test is still continuing concerned authority of the Commission is directed to permit the petitioner to participate in the Personality Test thereby extending opportunity to the petitioner to offer
her candidature in the Personality Test. If petitioner comes within zone consideration based on her performance in Personality Test, consequential steps shall be taken in connection with aforesaid selection process i.e. 2nd SLST, 2025.
8) With the aforesaid directions, writ petition stands disposed of.
9) There shall be, however, no order as to costs.
10) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
