Since the petitioner seeks expeditious disposal of C.S. 58200 of 2017 pending before the learned Metropolitan Magistrate, 6th Court, Calcutta, presently redesignated as the learned Judicial Magistrate, 6th Court, Calcutta, the matter may be taken up for consideration without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.

It appears from the record that after completion of examination of the accused under Section 313 of the Code of Criminal Procedure, an application was filed by the accused under Section 311 of the Code of Criminal Procedure which was allowed by the learned trial Court by an order passed on 1st April, 2022. Since then, several dates have been fixed by the learned trial Court for further examination of the witness and such examination is still pending.

In view of the above, the learned trial Court is directed to take necessary steps for conclusion of evidence at the earliest and in any event, take the proceeding to its logical conclusion within three months from the next date of hearing fixed before him, without granting any unnecessary adjournment to either of the parties, in accordance with law.

CRR 5336 of 2024 is disposed of.
