Heard the learned advocate for the contempt applicant and the learned advocate for the alleged contemnors.

The Division Bench directed for payment of the petitioner's pensionary benefits treating his last pay drawn in the post-graduate scale as the scale for the basis of calculation of retiral benefits. The Director of Pension, Provident Fund and Group Insurance has filed an affidavit, wherein a specific averment is made in paragraph 8 that a revised pension payment order was issued on the basis of the last basic pay which is fixed for post-graduate qualification of a teaching staff of secondary school. The order also is annexed thereto in support of such averment. The affidavit was filed

after due service upon the petitioner. The averments uncontroverted leave no room for doubt that the order has been complied with in letter and spirit.

The learned advocate for the petitioner, however, seeks to make further submissions which we are not inclined to entertain in this contempt application.

If there is any other due or any other grievance remaining, it will be open to the petitioner to take appropriate steps.

The Contempt Application is disposed of.
