It is submitted on behalf of the petitioner that the petitioner's father who was the only earning member of the family had expired on 27.06.2011 due to electrocution. The petitioner alleges that while cultivating his paddy field the petitioner's father was electrocuted because of alleged electric wires lying at the plot of cultivation.

On behalf of the WBSEDCL, it is submitted that the writ petition is misconceived and not maintainable. There is inordinate, unexplained and unjustified delay in the filing of the writ petition. The petitioner has approached this Court with unclean hands and the writ petition is liable to be dismissed.

The admitted facts of this case reveal that the demand for compensation is in respect of an incident which has occurred as far back as in 2011. The unexplained and unjustified delay in approaching this Court is sufficient reason for this Court not to entertain this writ petition. It is well settled that delay is a ground which defeats equity and disentitles the petitioner to any relief. The writ petition has failed to furnish any explanation and is raising a stale and outdated claim.

In view of the above, WPA 28803 of 2023 stands dismissed. However, there shall be no order as to costs.
