REJECTED C.R.M.(A) 5711 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Hili Police Station Case No. 229 of 2023 dated 19.11.2023 under Sections 21(c)/22(c)/23 (c)/27A of the NDPS Act. And In Re : Rashu Sarkar @ Rasu Sarkar ...... petitioner Mr. Kaushik Chaudhury Ms. Busra Khatun ....for the petitioner Mr. Madhusudan Sur Mr. Shashanka Shekhar Saha ....for the State Two neighbours implicate the petitioner in the dealing of Drugs.

Commercial quantity of Narcotics was seized from the coaccused. In view of the materials presently available, at the anticipatory bail stage, we are unable to return a finding that the petitioner is able to overcome the restrictions under Section 37 of the N.D.P.S. Act, 1985.

In such circumstances, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 5711 of 2023 is dismissed.
