Petitioner(s) Mr. Tapodip Gupta ... for the Petitioner(s) Mr. Iqbal Kabir Ms. Madhumita Basak ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year two months and the similarly placed accused persons have already been granted bail.

On the other hand, learned advocate for the State, opposes the prayer for bail and submits that there is complicity of the present petitioner and the evidence of the case has commenced.

Learned advocate for the State also submits that vulnerable witnesses are yet to be examined including CSW 2 and CSW 10 - who are very vital for the present case and, the next date for trial is fixed on 16th February, 2026.

Having regard to the fact that vulnerable witnesses are yet to be examined, I direct the State to expedite the examination of such witnesses and within three months from the next date so fixed, the evidence of CSW 2 and CSW 10 are completed.

Having considered the overall circumstances, I am not inclined to enlarge the present petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.

However, the petitioner can renew his prayer for bail after the aforesaid events and the period is over. Accordingly, CRM(M) 21 of 2026 is dismissed.
