... for the State Mr. Saini, the petitioner appears in person in this case. He is aggrieved with the order of the Trial Court dated 30.09.2015. It is submitted that by dint of the said order further investigation was directed by the Trial Court. It is further submitted that after completion of further investigation police has again submitted FRT and petitioner's grievance/allegations have still been left remediless. Mr. Banerjee, learned Advocate appears for the State and challenges the petitioner's case on the ground that the prayer made by him are vague and non-specific and no order could be passed on the basis of the same.

Considering the facts and circumstances of the present case, when after re-investigation police has submitted FRT, it is found that the petitioner is required to exhaust the due process of law in the Trial Court and thereafter, come to challenge any order of the Court, regarding which he might be aggrieved of.

Therefore, at this stage, this case is found not to be maintainable and the same is devoid of any merit.

On the ground as above, the present case is dismissed, however, with the liberty to the petitioner to file afresh in accordance with law. Since the grievance of the petitioner is a long pending one, I request the Trial Court to proceed as expeditiously as possible, in case the petitioner approaches the same with his prayer.
