It appears from the report that the petitioner and the private respondents are in possession of their respective shares in the land in question. The petitioner alleges that the private respondents have stacked material by encroaching upon the portion occupied by the petitioner for the purpose of dispossessing him therefrom. The petitioner filed an application under Section 147(3) of the Code of Criminal Procedure before the learned Executive Magistrate, Arambagh, Hooghly which is pending. The petitioner seeks to submit a comprehensive representation before the police authority seeking necessary relief against the private respondents. The petitioner is at liberty to do so. In the event the petitioner is aggrieved by the acts of the private respondents, he is at liberty to approach the appropriate forum for redressal of his grievance. With the aforesaid direction, the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
