Kausik (Allowed) CRM (NDPS) 7 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Swarupnagar Police Station Case No. 517/2025 dated 03.08.2025 under sections 20(b)(ii)(C)/29 of the NDPS Act and section 25/27/35 of the Arms Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 80 days and charge sheet has already been submitted in connection with the instant case.

It has been pointed out that the petitioner has been implicated on the basis of statement of co-accused and there are no materials to support the contention of the prosecution/investigation. In spite of the same, petitioner is in custody.

Learned advocate for the State produces the case diary and draws the attention to the statement of the two independent witnesses being CSW 7 and CSW 8. Both the

statements are related to the accused namely, Biswanath Mondal and not in relation to the present petitioner. Rest of the witnesses, in the present case, on inspection of the case diary I find, belong to the Government department.

Having considered the nature of complicity of the present petitioner and the evidence collected by the Investigating Agency, I am of the view detention of the petitioner is unwarranted in the facts and circumstances of the case.

Accordingly, petitioner, namely, Mukul Mondal @ Kabirul Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional District and Sessions Judge, 8th Court, Barasat 24 Parganas North.

If on bail, the petitioner shall not leave the district of 24 Parganas North without the leave of the learned Special Court. Accordingly, CRM (NDPS) 7 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
