Rakib (rejected) CRM (NDPS) 13 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Patiram Police Station case no. 3 of 2025 dated 01.01.2025 under Sections 21(c)/22(c)/23(c)/27A of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate for the petitioner submits that so far as the subject matter of the case is concerned initially there was a recovery of 20,725 ampoules of Buprenorphine injections. The said seizure was from different accused person and there are same persons who have been subsequently arrested and they were released on bail. So far as the present petitioner is concerned, petitioner was subsequently arrested but there has been recovery of 100 bottles of cough syrup. It has been submitted that prosecution has cited 28 witnesses in the charge-sheet and till date only one witness has been examined, although, the charge was framed on 22nd of July, 2024.

On the other hand learned advocate for the State opposes the prayer for bail and submits that the petitioner has

seven other criminal cases pending against him. It has been contended that the petitioner is on bail so far as those cases are concerned.

Be that as it may, having considered that witness action has already been commenced, at this stage, I am not inclined to release the petitioner on bail as there has been subsequent recovery pursuant to the statement of the petitioner. Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are over. Learned Special Court would give priority to the examination of the seizure list witnesses after passing necessary orders upon the Public Prosecutor conducting the case.

Accordingly, CRM (NDPS) 13 of 2026 is dismissed at this stage.
