CONSTITUTIONAL WRIT JURISDICTION Appellate Side WPA 27735 of 2007 Shrabana Goswami versus The State of West Bengal & Ors.

1. This instant writ petition has been filed by the writ petitioner seeking direction upon the respondent and/or the respondents concerned to re-examine and/or scrutinize the answer scripts of Paper-I, Paper-II, Paper-III and Paper-IV of Accountancy in B.Com (Honours) and on such re-examination and/or scrutiny thereof issue fresh mark-sheet on the basis of such re-examination and/or scrutiny of answer papers and/or to take such other steps as may be done so that the academic career may not be affected any more.

2. None appears on behalf of either of the parties. No accommodation is sought for.

3. None appeared on behalf of the petitioner even on the earlier occasions.

4. This case is pending since 2007, almost 19 years have passed.

5. No affidavit-in-opposition and affidavit-in-reply have yet been filed despite direction by the then Coordinate Bench vide order dated 17.09.2008 as per official report.

6. Considering the nature of prayer and the long pendency of the case, it seems to this court that the petitioner is not interested to proceed with the case anymore on two grounds. Firstly, the purpose of filing this writ petition has been either resolved and/or secondly, she has abandoned her prayer due to the passage of time. Furthermore, such a prayer cannot be entertained after expiry of almost 19 years.

7. In view of the facts and circumstances of this case, the writ petition being WPA No. 27735 of 2007 stands dismissed without any order as to costs.

8. Connected applications, if any, are also, thus, disposed of.

9. Interim order, if any, stands vacated.

10. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.

11. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
