Versus

The State of West Bengal and another The revisional application has been preferred for expediting the hearing of the interim maintenance application in connection with M Case No.382 of 2020 which is pending before the learned Judicial Magistrate, 2nd Court, Barasat, North 24 Parganas. The last of the order-sheet so enclosed reflects that on 14.08.2023 date was fixed for filing affidavit of assets by the parties and hearing of the interim application for maintenance.

Having considered that the application for interim maintenance under Section 125 of Cr.P.C. was filed in the year 2020, I direct that the learned Judicial Magistrate, 2nd Court, Barasat, North 24 Parganas would take steps by fixing one date in fortnight on and from 22.01.2024 so that the affidavits are filed by the first week of February, 2024 and the learned trial court would be in a position to decide the application for interim maintenance by 31st March, 2024.

With the aforesaid observations, CRR 4939 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

Department is directed to communicate this order to the

court of learned Judicial Magistrate, 2nd Court, Barasat, North 24 Parganas.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
