Petitioner and the private respondents are at loggerhead over a dispute relating to their property and it has been alleged that over issue relating to plucking of mangoes the private respondents exceeded their authority and brandished fire arms towards the petitioner. Petitioner informed the incident to the local police station being Raghunathganj Police Station, but no action has been taken by the police authorities.
I find that the information was furnished on 14.06.2023. Police authorities have enquired into the issue. However, over this issue proceeding under Section 107 of Cr.P.C. was drawn and again on 8th January, 2024 information was furnished and police
authorities again drew proceedings under Section 107/116 (C) of Code of Criminal Procedure.
Having considered that the police authorities had been keeping a strict vigil, I direct that such surveillance be continued by the police authorities and they would further ensure that no breach of the peace or tranquility takes place and/or any untoward incident results because of the inimical relationship existing between the petitioner and the private respondents.
With the aforesaid observations, WPA 28854 of 2023 is disposed of.
There will be no order as to costs.
Report submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
