Kausik (Rejected) CRM (M) 25 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Rishra Police Station Case No. 58 of 2023 dated 23.04.2023 under Sections 363/365 of the Indian Penal Code and under Section 4/8 of the POCSO Act and added section 376/328 of the Indian Penal Code and under section 6(1) of the POCSO Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 9 months and out of 25 witnesses proposed to be examined only 13 witnesses have been examined. As such the petitioner prays for bail on any stringent conditions. On the other hand, Mr. Das, learned Advocate appearing for the State submits that 16 witnesses have already been examined. Another 2 witnesses would be examined on 26.02.2026.
All efforts are being exerted by the prosecution within the limited set up for concluding the trial at the earliest. Learned advocate has produced the case diary. I have also assessed regarding the deposition of the victim before the Court as well as the medical report which is available in the case diary. On an assessment of the overall circumstances, I am of the view that this is not a fit case for releasing the petitioner on bail.
Accordingly, the prayer for bail of the petitioner in CRM (M) 25 of 2026 is dismissed.
