The petitioner seeks family pension. She claims to be the widow of one Bipan Behari Barman who was a teacher of a school who retired on August 31, 1995 and expired on April 19, 2023.

From the Pension Payment Order annexed to the writ petition, it does not appear that the pensioner disclosed the name of his heirs and legal representatives to receive family pension. 3.

The pensioner expired on April 19, 2023. The representation by the widow of the pensioner is pending consideration at the end of the DI of Schools (SE), Paschim Medinipur.

None represents the State. Affidavit of service is on record.

The instant writ petition is disposed of by directing the DI of Schools to consider the prayer of the petitioner for grant of family pension in accordance with law at the earliest but positively within twelve weeks from the date of communication of this order.

If the aforesaid respondent is of the opinion that the petitioner would be entitled to receive family

pension, then necessary consequential steps shall be taken without any further delay.

Learned counsel for the petitioner shall forward a copy of the representation along with all supporting documents to the aforesaid respondent at the time of communicating this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
