As none appears on behalf of the State, Mr. Jayanta Samanta, learned junior government advocate along with a junior of his choice is directed to represent the State. Their appointment may be regularised by the concerned authorities. The petitioner has approached this Court against the act and actions of the New Town Police Station. The basic allegation is against the respondent no.4. The petitioner complained against the respondent no.4 for which New Town Police Station Case No. 484/2016 dated 22.05.2016 was registered for investigation. On completion of investigation, charge-sheet was also filed on or about 31.05.2017.

In view of the nature of the accusations made and that the police authorities have already submitted charge-sheet before the jurisdictional court, I am of the view that presently the police authorities in respect of the court proceedings have no power to interfere. The petitioner if he is aggrieved by any subsequent conduct of the respondent no.4 will bring the same to the notice of

the learned jurisdictional Magistrate.

The jurisdictional Magistrate if required under the Witness Protection Scheme would pass appropriate direction.

With the aforesaid observations, the writ petition being WPA 30216 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
