Learned advocate appearing for the petitioner submits that petitioner is in custody for 1163 days.

Learned advocate for the State submits that the evidence of all the 19 witnesses has been examined out of 21 witnesses proposed to be examined. The report reflects that it has been informed that the examination of the case under Section 313 of the Code of Criminal Procedure has been completed. Having considered that date has been fixed for argument, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (M) 16 of 2026 is dismissed at this Stage.

In case the Presiding Officer of the Court in seisin of the case is absent, the learned District Judge, Murshidabad is directed to assign another Sessions Court for hearing the arguments of the case.

Let this order be communicated by the State through the Public Prosecutor conducting the trial in the trial Court to the learned District Judge, Murshidabad. The learned District Judge accordingly will pass necessary directions as he deems fit and proper regarding the availability of the Court concerned. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
