The grievance of the petitioner is directed against action initiated by the respondent bank under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

It is submitted on behalf of the petitioner that despite having served a communication to the respondent bank for restoration of property, neither the respondent bank nor the District Magistrate has taken any steps in the matter. 3.

In view of the statutory alternative efficacious remedy available under Section of the

Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, there are no grounds made out to entertain the writ petition.

Accordingly, WPA 29775 of stands dismissed.

Liberty is granted to the petitioner and the State to take necessary steps in accordance with law as expeditiously as possible.

It is made clear that there has been no expression on the merits of the case and all issues are left open to be decided by the appropriate authority. 7.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
