November 11, 2021 ARDR (26) MAT 2197 of 2017 + IA CAN 1 of 2018 (Old CAN 323 of 2018) + IA CAN 2 of 2018 (Old CAN 325 of 2018) Mahesh Kumar Sharma Vs.

West Bengal State Electricity Distribution Company Ltd. & Ors.

(Through Video Conference) Mr. Goutam Dey, Mr. Arup Kumar Ray, Mr. Pinendu Sarkar, ... for the petitioner.

Ms. Bandana Basu, ...for the respondents/WBSEDCL.

This appeal is directed against an interlocutory order dated 02/11/2017 passed by the learned single Judge, whereby interim relief has been declined. The record reflects that the appeal was defective though it was filed in the year 2017. Hence, it did not come up for such a long time and is listed today. Learned counsel for the respondents has pointed out that in the writ petition the Affidavit in Opposition was filed and a copy thereof was supplied to the counsel for the petitioner on 22/12/2017.

In view of the aforesaid, we are of the opinion that if the pleadings are complete in the writ petition then the parties can make a request to the learned

single Judge for expeditious decision of the pending writ petition.

We hope that the learned single Judge will duly consider the request having regard to the nature of the matter.

The appeal is accordingly disposed of. The applications are also disposed of.
