Malik Uddin, ...for the respondent no. 7 to 10 It does not appear that the petitioners are correct in contending that respondent nos.7 to 10 have undertaken construction without obtaining permission from the Panchayat Authority.

Learned Advocate appearing on behalf of respondent nos.7 to 10 has produced a copy of the permission granted by the Panchayat Authority. A copy of the said permission has been handed over to the learned Advocate appearing for the petitioners. It further appears that, with regard to the title of the property in question, a civil suit is presently pending between the parties.

In the aforesaid circumstances, there is no justification for entertaining the present writ petition.

This court is not the appropriate forum for adjudication of the said dispute.

Accordingly, W.P.A. 268 of 2026 stands dismissed.

It is made clear that the dismissal of this writ petition shall have no bearing upon the pending civil suit between the parties.

There shall be no order as to costs.
