CAN 1 of 2026 is an application for recalling the order dated 10th February, 2026 whereby and whereunder WPCT 2 of 2026 was disposed of for want of prosecution.

At the time of hearing Mr. Bajpai, learned counsel appearing on behalf of the petitioners/applicants submits before this Court that on 10.02.2026 the learned Advocate-on-Record of the writ petitioner could not ascertain the exact position of the instant writ petition due

non-functioning of the display board properly. As a result whereof, the learned Advocate-on-Record could not reach this Court when WPCT 2 of 2026 was called for hearing.

It is submitted further by Mr. Bajpai that non-appearance on behalf of the writ petitioners is purely unintentional and, accordingly, the prayer for restoration of the writ petition may be allowed.

The said prayer is vehemently opposed on behalf of the respondent. It is submitted that no plausible and cogent ground has been shown for recalling the order of dismissal as prayed for.

On careful perusal of the entire materials placed before us and on considering the submissions made by the contending parties, we are satisfied that the writ petitioners have duly explained the reasons of their absence on 10th February, 2026 when WPCT 2 of 2026 was called for hearing.

Accordingly, the prayer is allowed.

Consequently, the order dated 10th February, 2026 is hereby recalled subject to payment of cast of Rs.1000/- to be paid by the writ petitioners to Calcutta High Court Legal Services Committee within 15 working days from today.

Consequently, CAN 1 of 2026 is disposed of subject to payment of cost as indicated supra. Consequently, WPCT 2 of 2026 is restored to its original file and number.

Let the writ petition be listed in the Combined Monthly List of May 2026 under the heading "Hearing". Learned advocate for the writ petitioners is hereby requested to supply a copy of the instant writ petition to the learned advocates for the contending respondents forthwith.
