Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the petitioner tried to surrender before the learned jurisdictional Court in 2013 but the police did not arrest him. The husband has passed away.
Learned counsel appearing on behalf of the State relies on the case diary and the report and submits as follows. The petitioner is indeed the same person as Sk. Iqbal who is an accused in this case. He has remained an absconder since 2010. There are incriminating materials present in the case diary against the petitioner as regards the dowry death of the victim.
Considering the above, the other incriminating materials available in the case diary, the fact that the petitioner has remained absconding since 2010 and the proclamation and attachment had been issued against the petitioner, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
