In pursuance of the direction passed by this Court a report is submitted by the Superintendent, Jalpaiguri, Central Correctional Home, indicating that the present appellant/ convict had already served down the sentence and was released on 14.102019 on expiry of sentence and payment of fine.

The instant appeal is preferred at the behest of the appellant challenging the judgement and order of conviction passed by the learned Trial Court dated 22.9.2015 and 23.9.2015 in connection with Sessions Case No. 375 of 2013/ S.T. no. 2(11) 13 arising out of G.R. Case No. 2215 of 2013 corresponding to Kotwali Police Station case no. 560 of 2013 dated 20.4.2013.

As the appellant convict had already served out the sentence the instant appeal is liable to be dismissed.

Accordingly, the instant appeal be and the same is dismissed on merit. 7.

The impugned judgement and order for conviction passed by the learned Trial Court, in connection with Sessions Case No. 375 of 2013/ S.T. no. 2(11) 13 arising out of G.R. Case No. 2215 of 2013 corresponding to Kotwali Police Station case no. 560 of 2013 dated 20.4.2013 is hereby affirmed.

Thus, CRA 728 of 2016 is hereby disposed of.

Let a copy of this order alongwith Trial Court Record be sent down to the learned Trial Court immediately.
