Petitioner is in custody for a period of about 3 years and 4 months. 13 prosecution witnesses are scheduled to be examined at the trial. Only one was examined in part. Possibility of the trial concluding in the near future does not exist.
Role of the petitioner alleged is that he is the supplier of the raw materials for the purpose of manufacturing illegal arms.
Complicity of the petitioner may be decided at the trial.
In such circumstances, we are inclined to grant bail to the petitioner.
Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Chief Judicial Magistrate, Paschim Bardhaman at Asansol subject to the condition that the petitioner shall appear before the learned trial court on every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever. Petitioner will furnish his residential address in the jurisdiction of the local police station to the Officer-in-Charge of such police station and will report before the Officer-inCharge once a month. In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court. The prayer for bail of the petitioner is allowed. C.R.M.(DB) 4345 of 2024 is disposed of.
