Petitioners contend there were business transactions between the petitioners and the deceased. Out of depression, the deceased committed suicide. Accordingly, they pray for anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record including statements of wife and daughter of the deceased before Magistrate. They claimed deceased had asked the petitioners to refund monies which they refused and abetted suicide. Deceased has not left behind any suicide note. Whether the conduct of the petitioners in refusing to repay the dues would amount to abetment to suicide requires to be assessed at the appropriate stage of the proceeding. Under such circumstances, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioner viz., 1) Bulti Mondal and 2) Prabhat Mondal @ Pravat Mondal be released on bail upon furnishing a bond of Rs. 10,000/- each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of BNSS. They shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
