Mr. Mohan Kumar Sanyal, Mr. Dwaipayan Sanyal ...for the petitioner Mr. Somnath Ganguli, Ld. AGP, Mr. Balarko Sen ....for the State Affidavit of service filed in Court today is kept with the record.

Petitioner is aggrieved by the fact that his property is being encroached at the behest of the private respondents. To that effect petitioner has already approached the Civil Court and the grievance of the petitioner is that in spite of the Civil Court passing order, the harassment inflicted by the respondents are continuing.

State has submitted a report. Let the same be kept with the record.

Petitioner would be at liberty to approach the jurisdictional Civil Court which has passed the order for necessary police protection, if the Civil Court passes an order for police help in spite of

implementation of its order then the police authority would respect and obey the order the Civil Court. In the meantime, police authority would keep a strict vigil and ensure that no breach of peace takes place at the locale and/or no untoward incident takes over the subject of land which is in dispute. With the aforesaid observations, the writ petition being WPA 28892 of 2023 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
