04.01.2024 sdas rejected C.R.M.(NDPS) No. 2090 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Raghunathganj Police Station Case No. 313 of 2022 dated 10.05.2022 under Sections 21(c )/29 of the NDPS Act.

And In Re : Sasti Ghosh @ Shasthi .... petitioner Ms. Chandrima Debnath ....for the petitioner Mr. Koushik Kundu ... for the State 1.

Heard the learned Counsels for the parties.

We have considered the materials on record. There are prima facie materials disclosing involvement of the petitioner in the alleged joint possession of narcotics i.e. 10 litres of Codeine Phosphate which is above commercial quantity. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

3. Application for bail is, thus, rejected.

Trial court is directed to consider the issue of framing of charge at the earliest and conduct the proceeding to its logical conclusion without granting unnecessary adjournment to either of the parties.
