Affidavit of service filed by the petitioners and report submitted by State are taken on record. Learned counsel for the petitioners submits that the petitioners are cultivators and earn their livelihood by cultivating their land. A murder took place in the village following which the petitioners along with others were forced to leave the village. Now the petitioners seek to return to their village and collect the harvest. It appears from the report submitted by the State that the harvested paddy was collected by a close relative of the petitioners who sold the same to a rice dealer and received the sale proceeds which is in his custody. The petitioners are not named as accused in the FIR pertaining to the murder. There is round the clock police picket in the village to prevent any
untoward incident as the situation in the village is tense and breach of peace cannot be ruled out.
Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the petitioners are inclined to return to their village, they shall approach the Inspector-in-Charge, Sonamukhi Police Station, being the 3rd respondent herein, indicating the date and time of their intended return. The 3rd respondent shall render all assistance and protection to the petitioners in order to enable them to return to their village and reside there peacefully and safely.
The police authority shall continue their surveillance in the area in order to avoid any untoward incident and shall ensure maintenance of law and order. The police shall render necessary assistance to the petitioners as and when sought.
The writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
