Learned advocate appearing for the petitioner submits that the petitioner is in custody for six months and sixteen days and although the subject matter of the case involves 223 bottles of cough syrup. However, only 123 bottles of cough syrup/codeine phosphate mixtures were recovered from the present petitioner.

Learned advocate for the State opposes the prayer for bail and submits that date has been fixed for consideration of charges on 2nd of February, 2026.

Having considered the fact that there has been recovery in the present case and date has been fixed for consideration of charges, I am of the opinion that the petitioner would renew his prayer for bail before this Court after the evidence of the seizure list witnesses are over.

Learned Special Court is directed to pass necessary directions so that the seizure list witnesses are examined at an earlier date than proposed by the prosecution. However, the prayer for bail in CRM (NDPS) 15 of 2026 is rejected at this stage.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
