1. The revisional application has been preferred by the petitioner praying for transfer of Partition Suit no. 10 of 1973 from the Court of learned Civil Judge, Senior Division, Balurghat, Dakshin Dinajpur to the Court of learned Civil Judge, Senior Division, Raiganj, Uttar Dinajpur.

2. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the Partition Suit has been filed in the Balurghat Court at Dakshin Dinajpur by the opposite party herein.

3. The petitioner herein resides at Raiganj, Uttar Dinajpur.

4. Considering that the suit is now only pending final decree, the prayer for transfer at this stage stands rejected.

5. Keeping in mind the case and age of the petitioner herein, the learned Civil Judge, (Senior Division), Balurghat shall be at liberty to permit the petitioner/defendant to appear virtually, if petitioner makes such prayer.

6. CO 4569 of 2025 is disposed of.

7. Parties to act on the server copy of this order.

8. Let a copy of this order be sent to the concerned Courts for immediate compliance.
