Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. The title and possession of the petitioners have been declared by the competent civil Court on two occasions. Despite the same learned counsel for the petitioners submits that the private respondents have been disturbing their peaceful possession in the land and are taking away the harvest therefrom forcibly. They are also abusing the petitioners in filthy language and threatening them with dire consequences.

It is not in dispute that the appropriate civil forum has declared the title and possession of the petitioners in respect of the land in question and appeal preferred by the private respondents against such decree has been dismissed. The petitioners have been put in possession of the land in execution of the decree.

In view of the above, the police authority is directed to maintain strict vigil in the area in order to avoid any

untoward incident in view of the strained relationship between the parties and to ensure maintenance of peace and tranquility.

The police shall render necessary assistance/protection to the petitioners in terms of the decrees passed by the civil Court so that they are able to possess the property peacefully and without any obstruction or disturbance from any corner whatsoever. Such protection should be extended to the crops/harvest standing in the land of the petitioners.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
